16 دسمبر 2012 کو دہلی میں گینگ ریپ (gang-rape) کا ایک بھیانک واقعہ پیش آیا- 23 سالہ متاثرہ لڑکی کا صحافتی نام نِربھَے (fearless) بتایا جاتاہے- اِس بھیانک واقعے کے بعد ایک طبقہ مطالبہ کررہا ہے کہ مجرم کےلیے قتل کی سزا مقرر کی جائے- مگر ہیومن رائٹ ایکٹوسٹ (Human Rights Activists) اِس کے خلاف ہیں- اُن کا کہنا ہے کہ — ایک مجرم کی متشددانہ موت تشدد کلچر کو گھٹائے گی یا بڑھائے گی:
Any act of gross violence, of which gang-rape is the most repugnant, acts like a stone thrown into the still water of a pond. The impact of the stone causes ripples to spread over the surface of the entire pond, disturbing the water so that it no longer reflects the sky. An act of violence against one individual sends ripples of retributive counter-violence through all of us. It increases the Violence Quotient of us as a society. Hang rapists by all means. But will killing a rapist also kill the contagion of violence that prompted the rape in the first place, or will it only further spread that contagion? Will the violent death of a violent criminal increase or decrease our Violence Quotient?

مذکورہ مضمون میں اِس معاملے کو صحیح زاویے سے نہیں دیکھاگیا ہے- اِس میں مجرم کی سخت سزا کو تشدد کی نظر سے دیکھا گیا ہے- مگر صحیح یہ ہے کہ مجرم کی سخت سزا کو ایک مانع جرم سزا (deterrent punishment) کے زاویۂ نظر سے دیکھا جائے- تجربہ بتاتا ہے کہ سزا کی تخفیف سے جرم کی حوصلہ افزائی کا ماحول بنتا ہے اور سزا کی شدت سے جرم کی حوصلہ شکنی کا ماحول- ایک مفکر نے درست طورپر کہا ہے کہ — سزا کی شدت آدمی کو جرم سے نہیں روکتی، یہ سزا کی ناگزیریت ہے جو مانعِ جرم کا کام کرتی ہے:
It is not the severity of punishment that acts as a deterrent, it is its inevitability.
اللہ کی معرفت دین کی روح ہے۔ معرفت کے بغیر دین ایک بے جان صورت بن جاتا ہے۔
