يَـٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوٓاْ إِذَا تَدَايَنتُم بِدَيۡنٍ إِلَىٰٓ أَجَلٖ مُّسَمّٗى فَٱكۡتُبُوهُۚ وَلۡيَكۡتُب بَّيۡنَكُمۡ كَاتِبُۢ بِٱلۡعَدۡلِۚ وَلَا يَأۡبَ كَاتِبٌ أَن يَكۡتُبَ كَمَا عَلَّمَهُ ٱللَّهُۚ فَلۡيَكۡتُبۡ وَلۡيُمۡلِلِ ٱلَّذِي عَلَيۡهِ ٱلۡحَقُّ وَلۡيَتَّقِ ٱللَّهَ رَبَّهُۥ وَلَا يَبۡخَسۡ مِنۡهُ شَيۡـٔٗاۚ فَإِن كَانَ ٱلَّذِي عَلَيۡهِ ٱلۡحَقُّ سَفِيهًا أَوۡ ضَعِيفًا أَوۡ لَا يَسۡتَطِيعُ أَن يُمِلَّ هُوَ فَلۡيُمۡلِلۡ وَلِيُّهُۥ بِٱلۡعَدۡلِۚ وَٱسۡتَشۡهِدُواْ شَهِيدَيۡنِ مِن رِّجَالِكُمۡۖ فَإِن لَّمۡ يَكُونَا رَجُلَيۡنِ فَرَجُلٞ وَٱمۡرَأَتَانِ مِمَّن تَرۡضَوۡنَ مِنَ ٱلشُّهَدَآءِ أَن تَضِلَّ إِحۡدَىٰهُمَا فَتُذَكِّرَ إِحۡدَىٰهُمَا ٱلۡأُخۡرَىٰۚ وَلَا يَأۡبَ ٱلشُّهَدَآءُ إِذَا مَا دُعُواْۚ وَلَا تَسۡـَٔمُوٓاْ أَن تَكۡتُبُوهُ صَغِيرًا أَوۡ كَبِيرًا إِلَىٰٓ أَجَلِهِۦۚ ذَٰلِكُمۡ أَقۡسَطُ عِندَ ٱللَّهِ وَأَقۡوَمُ لِلشَّهَٰدَةِ وَأَدۡنَىٰٓ أَلَّا تَرۡتَابُوٓاْ إِلَّآ أَن تَكُونَ تِجَٰرَةً حَاضِرَةٗ تُدِيرُونَهَا بَيۡنَكُمۡ فَلَيۡسَ عَلَيۡكُمۡ جُنَاحٌ أَلَّا تَكۡتُبُوهَاۗ وَأَشۡهِدُوٓاْ إِذَا تَبَايَعۡتُمۡۚ وَلَا يُضَآرَّ كَاتِبٞ وَلَا شَهِيدٞۚ وَإِن تَفۡعَلُواْ فَإِنَّهُۥ فُسُوقُۢ بِكُمۡۗ وَٱتَّقُواْ ٱللَّهَۖ وَيُعَلِّمُكُمُ ٱللَّهُۗ وَٱللَّهُ بِكُلِّ شَيۡءٍ عَلِيمٞ
O you who have believed, when you contract a debt for a specified term, write it down. And let a scribe write [it] between you in justice. Let no scribe refuse to write as Allah has taught him. So let him write and let the one who has the obligation dictate. And let him fear Allah, his Lord, and not leave anything out of it. But if the one who has the obligation is of limited understanding or weak or unable to dictate himself, then let his guardian dictate in justice. And bring to witness two witnesses from among your men. And if there are not two men [available], then a man and two women from those whom you accept as witnesses - so that if one of the women errs, then the other can remind her. And let not the witnesses refuse when they are called upon. And do not be [too] weary to write it, whether it is small or large, for its [specified] term. That is more just in the sight of Allah and stronger as evidence and more likely to prevent doubt between you, except when it is an immediate transaction which you conduct among yourselves. For [then] there is no blame upon you if you do not write it. And take witnesses when you conclude a contract. Let no scribe be harmed or any witness. For if you do so, indeed, it is [grave] disobedience in you. And fear Allah. And Allah teaches you. And Allah is Knowing of all things
Where there is a cash transaction between two parties, the matter ends there itself. But contracting a debt is a different matter. In such a case, if the transaction is purely verbal, there is a possibility of differences arising due to the absence of written proof. Either party will present the matter according to his own perceptions, for there is no clear or absolute basis on which a proper decision may be arrived at. As a result, differences and complaints arise between the two parties at the time of payment. The only solution is to write down the particulars of the loan and then have witnesses testify to it. If any differences arise, this document would become the basis for a final decision. For a believer this would be a strategic safeguard based on taqwa and justice. In abiding by the written conditions and making a proper payment of dues, he acquits himself before the people and before God. Believers are witnesses of God’s religion. Just as they are not allowed to knowingly hide anything from God, they should similarly never conceal any evidence they may possess. Concealing evidence is to nurture a criminal mentality and to shirk the role they can play in making just decisions. Man’s conscience demands that the truth should be acknowledged and untruth should be proclaimed to be such. In matters of justice, one who withholds evidence for the sake of prestige or some other worldly considerations, is like a criminal who becomes a witness to his own crime.
دو آدمیوں کے درمیان نقد معاملہ ہو تو لین دین ہو کر اسی وقت معاملہ ختم ہوجاتا ہے۔ مگر ادھار معاملات کی نوعیت مختلف ہے۔ ادھار معاملہ میں اگر ساری بات زبانی ہو تو کاغذی ثبوت نہ ہونے کی وجہ سے بعد کو اختلاف پیدا ہونے کا امکان رہتا ہے۔ طرفین اپنے اپنے مطابق معاملہ کی تصویر پیش کرتے ہیں اور کوئی ایسی قطعی بنیاد نہیں ہوتی جس کی روشنی میں صحیح فیصلہ کیا جاسکے۔ نتیجہ یہ ہوتاہے کہ ادائيگی کے وقت اکثر دونوں کو ایک دوسرے سے شکایت پیدا ہوجاتی ہے۔ اس کا حل تحریر ہے۔ نقد معاملہ کو لکھ لیا جائے تو وہ بھی بہتر ہے۔ مگر ادھار معاملات کے لیے تو ضروری ہے کہ ان کو باقاعدہ تحریر میں لایا جائے اور اس پر گواہ بناليے جائیں۔ اختلاف کے وقت یہی تحریر فیصلہ کی بنیاد ہوگی۔ یہ مسلمان کے لیے تقویٰ اور عدل کی ایک حفاظتی تدبیر ہے۔ کتابت شدہ شرائط کے مطابق وہ اپنے حقوق کو ادا کرکے خدا اور مخلوقکے سامنے بری الذمہ ہوجاتاہے۔
مسلمان خدا کے دین کے گواہ ہیں۔جس طرح اللہ کی بات کو جانتے ہوئے چھپانا جائز نہیں، اسی طرح انسانی معاملات میں کسی کے پاس کوئی گواہی ہو تو اس کو چاہيے کہ اس کو ظاہر کردے۔ گواہی کو چھپانا اپنے اندر مجرمانہ ذہن کی پرورش کرنا ہے اور معاملہ کے منصفانہ فیصلہ میں وہ حصہ ادا نہ کرنا ہے، جو وہ کرسکتا ہے۔ انسان کا ضمیر چاہتا ہے کہ جب ایک چیز حق نظر آئے تو اس کے حق ہونے کا اعتراف کیا جائے۔ اور جب ایک چیز ناحق دکھائی دے تو اس کے ناحق ہونے کا اعلان کیاجائے۔ ایسی حالت میں جو شخص اپنے وقار اور مصلحت کی خاطر اپنی زبان کو بند رکھتا ہے وہ گویا ایسا مجرم ہے جو اپنے جرم پر خود ہی گواہ بن گیا ہو۔
